Owner of safe with marijuana pleads to misdemeanor

The 26-year-old Henderson man charged with felony drug possession — after four men attempted to rob his safe filled with marijuana — has pleaded guilty to a misdemeanor drug offense in Vance County Superior Court.

Kenneth Newcomb, of 2931 Thomas Road, Lot 12, was arrested on Aug. 28, along with Orrie K. Williams, Geoffrey Gattis, Torian Robertson and Glen Jones — who attempted to steal a safe with marijuana inside from the Thomas Road residence.

In April, Newcomb was indicted on one count of felony possession of marijuana with intent to sell, manufacture or deliver and one count of felony maintaining a vehicle, dwelling or place for criminal substances.

On July 22, Newcomb pleaded guilty to one count of misdemeanor possession of a schedule VI controlled substance. The other charges were dismissed.

Judge Allen Baddour sentenced him to a 45-day suspended sentence.

Ben Hunter, assistant district attorney, prosecuted the case for the state.

Newcomb was represented by Scott Hamilton.

Vance County deputies responding to the armed robbery encountered a vehicle matching the description given in an alert and conducted a traffic stop on N.C. 39.

Deputies seized the safe with 18 grams of marijuana from the vehicle, as well as a .22-caliber rifle and .28-caliber shotgun.

Williams, 24, attempted to run but was caught, and all four men were arrested.

Robertson, 23, of 524 Stone St., pleaded guilty to common-law robbery and sentenced him to 19 to 32 months — or 1½ to nearly three years — in prison.

Williams, of 3974 Jacksontown Road, pleaded guilty on March 18 to one count of common-law robbery and one count of assault with a deadly weapon upon a government official. He received the same sentence as Robertson.

Gattis, 19, of 203 N. Beckford Drive, pleaded guilty to common-law robbery in February. He was sentenced to about one to three years in prison.

Jones, 20, of 5338 Raleigh Road, Lot 108, pleaded guilty to a felony charge of fleeing to elude arrest.
