Rape suspect’s case continued to January

Daquan Keith Foster, charged with the March rape of a 51-year-old woman in the area of McBorn Street and Young Avenue, will be back in court in January.

Foster, 20, appeared before Superior Court Judge George Collins Jr. on Tuesday. His case was continued due to medical records not being available.

According to Nick Bagshawe, the request for the records should not have gone to Duke University Medical Center as originally noted in case files.

“The case was held in the third setting, as it has been several times before,” Bagshawe said, referring to the Superior Court Case Management System. “The request for medical records unfortunately went to the wrong hospital.”

The case has been delayed several times because of earlier delays in SBI lab work. Both Bagshawe and Bill Griffin, the prosecutor for the case, indicated in October that a deal on a plea was close at hand.

Foster, of 63 Lynnbank Estates Road, is charged on counts of rape and kidnapping from the March 28 incident.
