The 18-year-old Henderson resident charged in the death of a 55-year-old store clerk appeared in Vance County Superior Court on Wednesday in reference to a pending robbery charge.

Diaquan Waddell’s robbery with a dangerous weapon charge was removed from the case management system, which provides defendants with three chances to resolve their case before trial.

Judge Allen Baddour delared Waddell’s case exceptional, which means it is no longer in case management.

Previously, the first-degree murder charge was taken out of the system.

Waddell, 1828 S. Clearview Drive, faces three robbery with a dangerous weapon charges relating to the robbery reported at the Raleigh Road Convenient Mart on March 11 and two robberies reported at the Waffle House, 942 W. Andrews Ave., on March 13 and 18.

He is one of two co-defendants charged in connection with the death of Ahmed Shahit, who was shot during the March robbery while working at the BP store.
